Terms and conditions of Services

By making a booking with Sebastian Adventures you acknowledge that you have read, understand and agree to be bound by these terms and conditions during your time with us.

These terms and conditions are governed by and shall be construed in accordance with the law of the United States, and any claim brought under these conditions shall be subject to the exclusive jurisdiction of the United States.

Sebastian Adventures (THE TERM “SEBASTIAN ADVENTURES” INCLUDES ALL EMPLOYEES, AGENTS, REPRESENTATIVES, SERVANTS, ASSIGNS, SUCCESSORS, INSURERS AND SUBSIDIARIES OF SEBASTIAN ADVENTURES, PALM BEACH ADVENTURES LLC AND EDDISA LLC) shall not be liable to any Customers (THE TERM “CUSTOMERS” INCLUDES ALL PERSON THAT HE/SHE IS RENTING, OPERATING, OR USING THE EQUIPMENT, CRAIGCAT BOAT, OR OTHER VESSEL PROVIDED BY SEBASTIAN ADVENTURES) on Sebastian Adventures tour activities or boat rentals activities, for any loss or damage which arises out of or in connection with or as a consequence of the operation of Sebastian Adventures including, but not being limited to, loss of profit, damage to or loss of property or items belonging to the customers and any personal injury to the customers.

Sebastian Adventure shall not be liable to any operator/passenger whilst in any operation location or surrounding areas.

By making a booking with Sebastian Adventures you acknowledge that you agree to sign this INDEMNITY, WAIVER AND RELEASE OF LIABILITY AGREEMENT before the tour/activity.
Forget to sign or signature missing before the tour/activity don’t change that you agree this agreement.

All persons, operator (THE TERM “OPERATOR” IS USED TO DESIGNATE A BOAT’S DRIVER) and passenger, cruising on a vessel must pay for admission prior to boarding the vessel. Tickets must be retained at all times and submitted for inspection if required by any employee or agent of Sebastian Adventures. Any person attempting to gain admission to the vessel without a valid ticket may be ejected from the vessel and its vicinity.

1. Bookings

a. All bookings are non-refundable. Payment is due at the time of booking. Due to the nature of the business when bookings are confirmed Sebastian Adventures immediately incur expenses and costs directly relating to your booking whilst we prepare for your arrival.

b. All bookings are non-transferable, except at the complete discretion of Sebastian Adventures. Only in extenuating circumstances will bookings be considered for transfer and where at least a minimum of 24 hours notice of request is given via email, please note an administrative fee may apply of up to 50%. 100% Cancellation Policy within 24 hours before departure time also applies.

c. Sebastian Adventures reserve the right to move your booking time or day due to weather or operational needs or due to other company commitments. Sometimes governing body involvement may result in changes becoming necessary.

d. We will use all reasonable endeavors to ensure that Sebastian Adventures operates. However, we reserve the right, in our absolute discretion, whether for safety reasons or otherwise, and with or without prior notice, to cancel any tour/activity. In the event of such cancellation, Sebastian Adventures will fully refund any customers whose ride is cancelled, the cost of his or her prepaid ticket, but otherwise shall have no liability whatever, including liability for travel expenses or any other out of pocket expenses, in respect of the cancellation.

e. In the unlikely event that one vessel has to make an emergency return to the Operating Location (or any other along route) Sebastian Adventures will not be liable for replacement tickets and/or refunds.

f. All prices are in US Dollars, booking fees and tax is added to any booking. The final prices don’t include the park entrance fees.

g. Sebastian Adventures reserve the right, where necessary to deviate from tour/activity planned route.

h. Due to the nature of the business sailing times cannot be guaranteed, however, every effort will be made to keep on schedule.

i. All passengers should arrive at the Dock no less than 30 minutes prior to the tour time.

 j. Please be aware if you miss your scheduled departure you will not be eligible for a later booking or refund.

2. Education Requirement / Rules

a. The maximum number of persons allowed per Craigcat boat is two or 2. One (1) operator and one (1) passenger. (THE TERM “OPERATOR” IS USED TO DESIGNATE A BOAT’S DRIVER)

b. Passenger must be at least 6 years of age and accompanied by an adult (18+) who is a qualified operator to participate in the tour.

c. In Florida, anyone born on or after January 1, 1988, who operates a vessel powered by 10 horsepower or more must pass an approved boater safety course and have in his/her possession photographic identification and a boater safety identification card issued by the Florida Fish and Wildlife Conservation Commission or a Valid Temporary Certificate.

d. A person is exempt from this requirement if there is a person on board who is not affected by this law or is at least 18 years of age and holds a boater education I.D. card.

e. The operator person must be attendant to and take responsibility for the safe operation of the vessel and for any violation that occurs during the operation/tour/all activities.

f. Sebastian Adventures accepts no responsibility if any customer (operator or passenger) operates a vessel and don’t have in his/her possession photographic identification and a boater safety identification card issued by the Florida Fish and Wildlife Conservation Commission or valid Temporary Certificate.

g. Sebastian Adventures accepts no responsibility if any operator/passenger violate Florida’s boating laws or any other laws.

h. By making a booking with Sebastian Adventures any operator/passenger acknowledge that he/she will read, understand and agree a Rules and Safety Agreement and agree to sign it before the tour/activity. Forget to sign or signature missing before the tour/activity don’t change that you agree with these Rules.

i. If any operator or passenger don’t respect the rules and information provided in the Rules and Safety Agreement or violate the Florida’s boating laws or any other laws Sebastian Adventures can take the decision to cancel the tour/activity for all participants. If canceled the tour/activity it will be non-refundable.

j. Alcoholic beverages are strictly prohibited on the tour/activity. Intoxicated persons will not be allowed to participate in the tour/activity.

k. There is a 300lb/person (operator or passenger) weight limit. This limit is put forward by the Craigcat Boat manufacturer for safety purposes.

3. Medical Conditions & Pregnancy

a. The decision to sail and the consequences of doing so are entirely at the operator and passenger’s own risk. Sebastian Adventures does not accept any liability for personal injury, or injury to others and/or loss or damage.

b. Without exception, expectant mothers are not permitted onboard at any stage of their pregnancy.

c. All boats can experience unpredictable movements that could aggravate existing medical conditions. You must inform us of any material fact, including medical conditions or disabilities, which may affect the skipper’s decision to carry you as a passenger, especially epilepsy, dizzy spells, diabetes, angina or any other heart conditions, back/bone conditions and pregnancy (this is not an exhaustive list).

4. Clothing and safety equipment

a. Sebastian Adventures recommend your party to “dress for the weather” bearing in mind it is usually cooler on the sea compared to the shoreside and extremely hot in the summer months. All Operators and passengers should arrive in suitable attire which will not be damaged by exposure to sea water or sunlight.

b. Life jackets are provided.

c. Sunglasses are required.

d. Sebastian Adventures accepts no responsibility if any personal belongings are damaged, lost or stolen at any time whilst on the park.

5. Comfort and Wellbeing

a. Alcoholic beverages are strictly prohibited on the tour. Intoxicated persons will not be allowed to participate in the tour/activity.

b. Vessel Operators and Passengers will not be permitted to board if Sebastian Adventures find that individual has:

1. Been convicted of a criminal offense which, in the opinion of Sebastian Adventures, is likely to affect the safety or enjoyment of other customers/visitors.

2. Behaved in a manner which, in the opinion of Sebastian Adventures has, or is likely to affect the safety or enjoyment of other customers/visitors.

3. Used threatening, abusive or insulting words or behavior or in any way provokes or behaves in a manner which may provoke a breach of the peace.

4. Shown signs of discourtesy, abuse or aggression to Sebastian Adventures crew.

c. Sebastian Adventures prevent offensive weapons or dangerous articles from being taken onto the vessel, operator, passenger, visitors are admitted subject to a condition that, if requested to do so, they will allow themselves and/or their belongings to be searched.

d. It is prohibited to take onto the vessel any weapons including fireworks, smoke bombs, glass bottles, flammable liquids or other articles, which may cause injury. The throwing of any article from vessels is strictly prohibited.

e. Smoking is strictly prohibited on the vessel itself and on the boarding platform/area leading to the vessel.

f. Pets or animals of any nature are expressly prohibited on the vessel itself and the boarding platform/ area leading to the vessel without the express permission of Sebastian Adventures.

g. Unnecessary noise, (such as that from the use of radio sets and other electrical equipment), or any behavior likely to cause annoyance to other customers or confusion of any kind is not permitted on or in the vicinity of the vessel.

h. Sebastian Adventures request you are respectful of our staff, other operators, passengers, visitors and neighbors. Whilst onboard please refrain from offering obscurities, profanities or any indecent hand/body gestures to members of the public or other sea goers.

i. Sebastian Adventures, its employees or agents shall not be liable for any loss or damage, direct or indirect, howsoever arising, including without limitation any distress, inconvenience or anxiety caused during the course of any cruise undertaken and/or during evacuation from the vessel in the event of breakdown or accident.

j. Sebastian Adventures cannot be held responsible for weather conditions during your experience. Without exception poor weather will not be deemed a valid reason to authorize relocation of any booking.

k. Any person under 18 years old must be accompanied by a responsible adult (+18) at all times.

l. Craigcat Operators and Passengers must remain seated at all times during their experience except when directly instructed by a representative of Sebastian Adventures that it is safe to move around, embark/disembark.

6. Private Transfers and Charters

a. All vessels will be hired on a “Private Charter” basis. The maximum number of persons allowed per boat is two or 2. One (1) operator and one (1) passenger.

b. A vessel may only be privately operator by persons aged 18 years or over.

c. No ticket/booking may be resold without the previous written consent of Sebastian Adventures. If Sebastian Adventures reasonably believes that a ticket has been resold without such consent, the holder may be refused entry to or ejected from the vessel without payment of compensation.

d. Sebastian Adventures are able to suggest approximate timings based on the logistics of your booking, however, where there are elements out of our control we kindly recommend you contact all other event organizers and transport providers to check your specific timings independently prior to confirming your booking with Sebastian Adventures. Sebastian Adventures will be held responsible for their service only.

7. Photography

a. From time to time Sebastian Adventures or other authorized parties will carry out photography and/or video recording and/or other monitoring on or in the vicinity of the vessels which may feature Operators/Passengers/Visitors. By accepting these terms and conditions, you agree that Sebastian Adventures or any authorized party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Sebastian Adventures or such authorized party (as the case may be).

b. Sebastian Adventures allow customers to take their own photography from their seats. We are not liable for any damage to equipment during this operation. Where customers request our employee to use their camera/recording equipment Sebastian Adventures will not be liable for any damage incurred as a result.

8. Vouchers

a. Gift vouchers can be purchased on an individual or charter basis online or over the telephone.

b. Ensure to pre-book by email to avoid disappointment.

c. All vouchers are valid for a full twelve months from the date of issue, booked and sailing date within this period.

d. An extension of six months can be applied for but will incur a 20% administration fee as standard. Up to two extensions can be applied for, after this time vouchers will automatically expire.

e. Reseller/Third party/Agent vouchers will expire as per their booking terms and conditions.

9. Complaints and Feedback

a. Any customers complaints should be brought to the attention of the crew on the day of your booking.

b. Following this, any further complaint should be put in to writing no less than seven days following your experience to info@sebastianadventures.com.

c. Compliments and general feedback will be gratefully accepted to the same email address.

d. Sebastian Adventures endeavors to respond to your correspondence within 72 hours, however, on occasion and where an internal investigation is necessary this can take longer.

10. Privacy

You have read our Privacy Policy, the terms of which are incorporated herein, and agree to such terms.

THE SERVICES AND MATERIALS PROVIDED BY THE SITE ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE, AND OUR PROVIDERS OR DISTRIBUTORS, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO: (1) IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, AND TITLE TO ANY OF THE SERVICES AND MATERIALS PROVIDED ON THE SITE; (2) ANY WARRANTIES THAT THE FUNCTIONS CONTAINED IN THE SERVICES AND MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (3) ANY WARRANTIES REGARDING THE USE, OR RESULTS OF THE USE, OF THE SERVICES AND MATERIALS PROVIDED BY THE SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, TIMELINESS, OR OTHERWISE. YOU ALONE ASSUME ANY AND ALL COSTS ARISING IN CONNECTION WITH YOUR USE OF THE SITE. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
